Approval of Amendment C212more
Amendment C212more was approved by the Minister for Planning on 30 August 2022 and came into operation on 21 September 2022, when the notice of approval was published in the Victorian Government Gazette. Download a copy of the notice of approval.

About Amendment C212more
Amendment C212 seeks to improve the operation of the Moreland Planning Scheme and planning permit decision making by introducing new policy content, new planning permit application requirements, and correcting a number of anomalies and errors/inconsistencies identified in the Moreland Planning Scheme.
What does Amendment C212more do?
Amendment C212 appplies to all land across the municipality. It proposes to:
- Delete Design and Development Overlay Schedule 7 from 1-5 and 2-34 Mary Moodie Way; 2-4 Bill Barry Close; 1-21 and 2-20 Dianella Walkway; 1-3 and 2-4 Edwina Way; 1-45 and 2-40 Gear Street; 1-19 and 2-20 Lomandra Walkway; and 12-20 Miller Street, Brunswick East (formally known as 2 John Street and 12-20 Miller Street).
- Delete Design and Development Overlay Schedule 9 from 1-11 and 2-12 Copper Lane; 1-17 and 2-16 Pimbial Court; 1-39 and 2-38 Stonewood Circuit; 2-10 Walter Street; and 3-23, 4-16 and 22 Win-Malee Street, Hadfield (formally known as 2-6 and 8-10 Walter Street, Hadfield).
- Introduce non-policy neutral changes to the Municipal Planning Strategy and Planning Policy Framework to give effect to Council adopted strategies and recommendations from the 'Planning Scheme Review Report 2018'.
- Introduce 3D Modelling application requirements for the Brunswick Activity Centre and Neighbourhood Activity Centres by amending Design and Development Overlay Schedules 18, 19, 20, 22, 23 and 24.
- Correction of anomalies by fixing ordinance, mapping and clerical errors, including rezoning of land at 6 McDonald Street, Coburg North.
- Rezoning of land purchased for new parks as part of a 'Park Close to Home' to Public Park and Recreation Zone.

Council Consideration of Panel Report and Adoption
On 8 June 2022 Council considered the recommendations of the Panel and resolved to:

Notes the findings and recommendations of the C212more Panel included at Attachment 1 to this report.

Adopts Amendment C212more to the Moreland Planning Scheme pursuant to Section 29(1) of the Planning and Environment Act 1987, as exhibited and with the changes recommended by the Planning Panel and discussed at Section 3 of this report and shown at Attachment 2.

Submits Amendment C212more to the Moreland Planning Scheme to the Minister for Planning for approval, pursuant to section 31 of the Planning and Environment Act 1987.

Exhibition of Amendment C212more
Amendment C212more was on public exhibition from 7 October 2021 to 5 November 2021. The outcome of the exhibition was presented to Council at the 8 December 2021 Council meeting. Here Council considered all submissions to C212more and resolved to refer the amendment and all submissions to an independent advisory Panel (Planning Panels Victoria).

Privacy
Please be aware that Merri-bek City Council collects information from organisations and individuals during the planning scheme amendment process through submissions made to an Amendment. Submissions may be hand written, electronic (both written and audio-visual) and often contain images, maps and plans. Submissions frequently contain personal information which at times may be sensitive for commercial, health or other reasons.
Natural justice and transparency are important parts of the Planning Scheme Amendment process. Under section 21(2) of the 'Planning and Environment Act 1987 (Vic)', Council must make all submissions to an Amendment available to view by any person at its offices for a period of two months after the Amendment is gazetted or lapses. This includes all personal names and address details. Submissions may also be emailed or posted to interested parties during the Planning Scheme amendment process.
Submissions are used by Council when assessing the Amendment and summaries of your submission are included in any Council report that considers the Amendment following the close of exhibition. Your submission will also be used and disclosed in the public process of a Panel Hearing if one is required. Any submission forwarded to Planning Panels Victoria will be managed with in accordance with their privacy policy.
Publication of Submissions on Council’s Website
Council will make all submissions available to view online on its website during the Planning Scheme Amendment process. All submissions made available online will be redacted to remove personal names, telephone and address details (with the exception of a property address that is the subject of the Amendment). Submissions will be removed from the website once the Amendment is finalised.
Use of your personal information
In accordance with the 'Privacy and Data Protection Act 2014 (Vic)' and 'Health Records Act 2001 (Vic)' the personal information submitted by you is being collected by Merri-bek City Council for the submission process and it will not be disclosed to any other external party without your consent, except as a requirement of the 'Planning and Environment Act 1987 (Vic)'. This includes disclosing your personal information upon request (name and address only) to any person who made a submission during the Planning Scheme Amendment process.
If you do not provide your name and address Council will not be able to consider your submission.
